Go4outsourcing.com is operated by Globotech Solutions Pty Ltd (ABN 53 107 593 993) headquartered in Melbourne Australia.
This Agreement (hereinafter referred to as the "Agreement") explains the contractual agreement between Go4outsourcing.com ("Go4outsourcing.com", "we", "us","our") and you (“Company”, "you", "your"). This Agreement governs your use of the Go4outsourcing.com Web Site (the "Web Site") and transactions conducted through this Web Site including, but not limited to, the billing and payment services described herein. We may revise these terms from time to time and provide you with notification of the changes by sending you an email or posting a message on the Web Site. Unless otherwise provided below, the revised terms will take effect when they are posted.
1. CLICK "I AGREE"
By using the Web Site clicking the "I Agree" checkbox on the buyer registration form, you are designating yourself as a “Buyer” (as defined in Section 3) and you acknowledge your acceptance of the terms and conditions of this Agreement. By accepting the terms and conditions of this Agreement and completing the registration process, you are simultaneously (i) registering as a "Registered User" (as defined in Section 2), (ii) representing and warranting that you can legally enter into this Agreement, and (iii) agreeing to the terms and conditions of this Agreement. If you do not accept this Agreement, you are not authorized to register and use the Web Site. This Agreement effective from the time that you click the “I Agree” checkbox on buyer form.
2. BACKGROUND
The Web Site provides a venue for Buyers to post projects and search for Service Providers. Similarly for service provider to find projects and apply for projects. Via the Web Site, we provide certain information about our products, services and users, and certain other third party information. We may at our discretion add, delete, modify and/or discontinue the Web Site or some or all of our services and information provided on the Web Site.
INTERPRETATION
In this Agreement:
"Content" means images, photographs, illustrations, text and other materials uploaded by a Buyer and/ or the Service Provider.
"Payment Service" is the service which allows
service providers the option to collect payment for the invoices from
Buyers through electronic transmission using our EasyPay payment system
as defined below.
"EasyPay payment system" is the name of the
internal payment system provided by us.
"Registered User" or "User" or "Registered Users" or "Users" means all individuals or other legal entities including registered body corporates who have registered to use the Web Site.
"Services" are those services provided by Service Providers as listed on the Web Site or the services rendered by us as specifically set out in Section 5 of this agreement.
"Buyer" is a Registered User or User who wishes to engage the services of a Service Provider.
"Service Provider" is a Registered User which provides services.
"RFP" is a request for proposal.
3. USER TYPES
BUYERS
Buyers may use the Web Site to request assistance from Service Providers for existing and proposed business projects, screen potential service providers and discuss project details with them. There are various communication tools set up within the Web Site including the project clarification board, private message board, project support system and chat tools which help in increasing performance, reliability and overall experience. RFPs/project postings are listed here without charge, with the exception of gold and platinum level projects which may require the payment of a deposit which will be determined by us. This deposit will be refunded on the successful award of the project.
There is a 5% administration cost to refund the deposit amount.
SERVICE PROVIDERS
Service Providers may use the Web Site to apply & respond to buyer-posted RFPs or service request, to discuss project details for performing the work on public message boards, private message board, chat system and to manage projects online via the project support system offered. They can also review the reliability and overall experience they had with specific Buyers at the end of each project. Service Providers must invoice buyers through our invoice system. Service providers pay a per-transaction fee for each invoice paid by buyer through the EasyPay
payment system or outside our EasyPay payment system as a result of their participation on the Web Site.
4. SCOPE OF SERVICES
We shall provide services to both Service Providers and Buyers. We may add, delete, or modify some or all of the Services at any time. We do not control the actual transactions between Service Providers and Buyers. Accordingly, we do not set or endorse: (i) the price, contract terms, quality, performance or legality of the services or projects advertised or offered; (ii) the ability of Buyers or Service Providers to offer services or any other type of working relationship; or (iii) the ability of Service Providers to offer services and perform them. We are not responsible for any transaction and or contact, or the result of any such transaction and or contact made by and between Registered Users. From time to time, we may provide new features and services on the Web Site. Those features and services shall be subject to the terms of this Agreement, but are also shall be subject to the additional terms and pricing as shall be specified on the Web Site. With respect to these features and services provided on our Web Site, you will be charged, and agree to pay us any fees, as set forth in separate sections of the Web Site detailing such features and services.
